On Thursday, October 20, 2005, TFC J. Linger was patrolling Loveville when he observed Joseph Francis Yates, 46, of Loveville riding his bike on Kavanagh Road.

TFC Linger recognized Mr. Yates from previous law enforcement arrests.  TFC Linger  knew from being present in District Court that morning that Yates failed to appear for his court date and Judge Slade issued a bench warrant for his arrest.

TFC Linger advised Mr. Yates that there was a warrant for failing to appear and he was under arrest.  When TFC Linger attempted to grab Mr. Yates’ right wrist he violently pulled his arm up to his body and held it close to his body.  Numerous commands to cooperate and stop resisting the lawful arrest were made.  After a brief struggle Mr. Yates was placed in handcuffs.

Once in custody Mr. Yates began yelling profanities and making threats toward TFC Linger.  Mr. Yates continued to be uncooperative and violent at the Detention Center.  Mr. Yates was served with the arrest warrant and charged with resisting arrest.  He is being held pending a bond review.
