Five Arrested for Weapons Charges

At approximately 2 a.m. on Saturday, July 11, Police responded to the area of Fox Chase Apartments in Great Mills for a shooting complaint. After hearing complainants, police began looking for a Cadillac sedan believed to be carrying the suspects.

Authorities subsequently stopped a Cadillac on Belvoir Rd just off Chancellors Run Rd in California. After an investigation, police discovered a concealed weapon and arrested five black males.

BCI was called in to continue the investigation. All five suspects were charged with weapons violations and a fifth suspect was charged additionally with Dangerous Weapon-Conceal.

Arrested were: Derrick J. Day, 24 of Leonardtown, charged with carrying a Handgun in Vehicle: Jerry J. Esetp, 19 of Great Mills, charged with carrying a Handgun in Vehicle, Zachary A. Faxon, 20 of Lexington Park, charged with carrying a Handgun in Vehicle, Elvis T. Frederick, 23 of Loveville, charged with carrying a Handgun in Vehicle, Jerell D. Owens,22 of Callaway, charged with carrying a Handgun in Vehicle and Dangerous Weapon-Conceal.

That is a lot of police vehicles in pic #6. Must of had the whole force after them.

Who cares how many police are sent. Send the whole force if that's what it takes. I'm glad they got these thugs off the streets.

So
If you can't carry a handgun in a vehicle, how do you get it from one place to another? So did 4 out of the 5 have the handguns on their laps and the 5th person had it hidden under his shirt?

MD Gun Law
A person may transport a handgun if they can demonstrate that the handgun is being carried, worn or transported:

To or from a place of legal purchase or sale, or repair shop.

Between a person's bona fide residences, or between his residence and place of business, if the business is operated and substantially owned by that person.

While engaged in, or traveling to and from a target shoot, formal or informal target practice, sport shooting event, hunting, trapping, or dog obedience training class or show.

By a bona fide gun collector who is moving any part or all of his gun collection from place to place for public or private exhibition.
During transportation to and from the above places the handgun must be unloaded and carried in an enclosed case or enclosed holster. An additional penalty is provided for any person convicted of unlawfully wearing, carrying or transporting a handgun, if his deliberate purpose was to injure or kill another person.

This is very confusing at best, and a very grey area. It leaves your fate up to the decision of the officer, and no two decsions will be the same. I doubt though they were going to a target range at 2 am. My best advise is this. When I go to the range, the ammo is locked up in a ammo box, the reciever, or cylinder is in another box, and the gun is holstered or in its case in plain view, locked up in the trunk. If all is seperated, you are least likely to be accused of being involved in mis doings.

Transportation of Firearms

Maryland prohibits the knowing transportation of a handgun, whether openly or concealed, in a vehicle traveling on a state highway, waterway, airway or a road or parking lot generally used by the public. Md. Code Ann., Crim. Law § 4-203(a)(1). Exceptions to these provisions include transporting a handgun to or from:

A place of purchase or repair;

A residence and business; or

An organized military activity, formal or informal target practice, sport shooting event, or hunting.

Section 4-203(b).

Under these exceptions, the handgun must be unloaded and carried in an enclosed case or holster. Section 4-203(b)(3). A person violating this section is guilty of a misdemeanor and subject to imprisonment for up to three years or a fine of up to $2,500. Section 4-203(c). Penalties may be enhanced for carrying a handgun onto school property or for repeat offenders. Id.

ANOTHER EXAMPLE of the Maryland law. I also forgot to mention, I use trigger locks in all firearms I have ever transported from a store, hunting, etc. Confused yet? Go google Georgias, and Virginia's gun laws. After all these safety's I put in place I still feel that I am at the fate of the officer in charge if stopped for a moving/equipment violation. These guys were out for a hit, and wrong-doing plain and simple, no excuse.

another questiton i have, was the gun stolen? most likely. and does maryland have the same law as virginia that if caught with a stolen gun in your posession your sorry but is gone for a min 5 years? no if ands or buts, and no probation.

But really, I always have a concealed weapon hidden in my car...don't leave home without it..

Broken Justice System.....
I feel if you cannot carry an unloaded gun (especially a HAND GUN) in a case or holster ; or with a trigger lock on it until you have transported it to its destination (for hunting, target practice, repair shop, home or where ever it is to be stored), you should have your right hand amputated as punishment, because if you cannot, you may have intentions in doing no good otherwise.

What!!!
The article says they found a concealed weapon and arrested 5 guys. So was it one weapon and they arrested five guys or five weapons on 5 people. Only one weapon is shown, usually with multiple weapon arrests they display all the weapons on the trunk of the vehicle or on a table at the police station. Baynet tie up the loose ends.

From What I Hear....
It looks as though the Sheriff's office should consider starting a real "gang" unit.
Gangs are becoming a bigger and bigger problem!!
